Issue:

Based on interview and document review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) were not disclosed to an entity not authorized to receive the information. This failed practice resulted in Patient A's Magnetic Resonance Imaging (MRI) report being reviewed by the unauthorized personnel. Findings:On November 30, 2012, at 9:50 a.m., the facility's Director of Accreditation, Regulation and Licensing (DOA) was interviewed by phone. The DOA stated on November 26, 2012, the Radiology Assistance Director received a fax from an individual indicated he received one of their patient (Patient A)'s MRI report by fax. The DOA stated the Radiology staff provided the contracted MRI service with the wrong fax number. The DOA stated the individual brought Patient A's MRI report back to the facility on November 26, 2012. The report was reviewed by the physician. Patient A was notified with the MRI result and the unauthorized disclosure of her PHI. On December 6, 2012, a review of facility documents included:a. Patient A's MRI report. The PHI included Patient's name, sex, age, medical record number, clinical indication, findings, and the final result. b. The letter addressed to Patient A, dated November 28, 2012, indicated the facility notified Patient A of the privacy breach.
