PART I-A, LINE 1: DURING THE YEAR ENDED JUNE 30, 2015, NSBA DETERMINED THAT TWO OF ITS EMPLOYEES MAY HAVE SPENT TIME DURING NORMAL NSBA WORK HOURS ON POLITICAL CAMPAIGN ACTIVITIES. NSBA'S DEPUTY EXECUTIVE DIRECTOR TOOK AN UNPAID LEAVE OF ABSENCE DURING MAY 2015 TO RUN FOR ELECTIVE OFFICE IN NEW JERSEY. THIS INDIVIDUAL'S EXECUTIVE ASSISTANT, ALSO AN NSBA EMPLOYEE, OFFERED TO ASSIST WITH THE CAMPAIGN, BUT ONLY BEFORE OR AFTER REGULAR NSBA OFFICE HOURS. TO DETERMINE WHETHER ANY NSBA RESOURCES MAY HAVE INADVERTENTLY BEEN USED IN CONNECTION WITH THE CAMPAIGN, NSBA ENGAGED OUTSIDE LEGAL COUNSEL TO CONDUCT A THOROUGH INVESTIGATION OF CAMPAIGN ACTIVITIES AND POTENTIAL USE OF NSBA RESOURCES IN THOSE ACTIVITIES. OUTSIDE COUNSEL ADVISED NSBA THAT THE USE OF NSBA STAFF, WORKING AT NSBA OFFICES USING NSBA COMPUTERS AND PRINTERS, WHETHER DURING WORK HOURS OR NOT, CONSTITUTES A POLITICAL EXPENDITURE BY NSBA. OUTSIDE COUNSEL DETERMINED THAT SUCH USE OF NSBA RESOURCES OCCURRED PRIOR TO THE DEPUTY EXECUTIVE DIRECTOR'S LEAVE OF ABSENCE. OUTSIDE COUNSEL ALSO DETERMINED THAT THREE HOURS OF THE DEPUTY EXECUTIVE DIRECTORS' TIME AND TWO HOURS OF THE EXECUTIVE ASSISTANT'S TIME WERE SPENT ON POLITICAL CAMPAIGN ACTIVITIES WHILE AT THE NSBA OFFICE. OUTSIDE COUNSEL ADVISED TO HAVE THE DEPUTY EXECUTIVE DIRECTOR REIMBURSE NSBA FOR THE VALUE OF SUCH TIME. CONSEQUENTLY, IN OCTOBER 2015, THE DEPUTY EXECUTIVE DIRECTOR FULLY REIMBURSED NSBA FOR THE FULLY-BURDENED COST TO NSBA OF THAT TIME, IN THE AMOUNT OF $513, PLUS THE RELATED EXCISE TAXES OF $64, FOR A TOTAL REIMBURSEMENT TO NSBA OF $577. IN ADDITION, A POLITICAL ACTIVITY POLICY WAS ADDED TO THE STAFF SECTION OF NSBA'S POLICY MANUAL PROHIBITING THE USE OF NSBA RESOURCES IN CONNECTION WITH POLITICAL CAMPAIGN ACTIVITIES IN SUPPORT OF OR IN OPPOSITION TO CANDIDATES. AS SUCH, NSBA AND NSBA STAFF ARE PRECLUDED FROM USING INTELLECTUAL PROPERTY, NSBA STAFF, OR OTHER NSBA RESOURCES AS THEY PERTAIN TO ANY POLITICAL ACTIVITY.
