@RLHeppner @TulsaLawReview Great article. I agree, if only for the reason that fuzzy “final order” rules offer litigants a menu of flexible strategic moves. I don’t mind chess games in litigation. I admit I once used the fuzzy rules in state court to the advantage of a client.

I’m obviously adding Gorsuch’s majority opinion in Bostock v. Clayton County to my Spring 2021 1L Constitutional Law syllabus. But Kavanaugh’s dissent will certainly be thoroughly discussed as, uh, a threat to the rule of law as a means to social change.
