The instructions require the bill to be reported back to the House with an amendment to strike the provisions of the bill that bar execution of prisoners who demonstrate that their death sentence was imposed because of racial discrimination, and that permit the use of statistical evidence showing a significant racially discriminatory pattern in this determination. In lieu of the title being struck, the amendment inserts a new title IX entitled the Equal Justice Act.
