The organization continues to engage in discussions surrounding the upcoming Farm Bill, conservation programs, and other related legislation and programs that impacts agricultural producers.
The organization has been in contact with our congressional delegation and agencies about priorities related to climate and sustainability. In addition, we have held discussions regarding clean water and our engagement on various agricultural input products such as pesticides and other regulatory issues. We also engaged in discussions surrounding endangered species and pesticide uses.
The organization engaged in discussions surrounding drought-related tax provisions for cattle farmers as well as conversations regarding upcoming sunset provisions in the previously approved Tax Cuts and Jobs Act.
The organization engaged in conversations regarding additional reporting requirements for small businesses under the Beneficial Ownership provision. We also worked to public educate our membership and legislators on the impacts of this provision.
Farm Bureau is involved in discussions related to energy production as well as landowner rights as new energy projects are proposed for construction.

The organization is concerned with retaliatory tariffs by China on U.S. agricultural goods. We have made contacts with our congressional delegation and USDA to communicate these concerns and urge a solution that does not harm farmers and ranchers. We also have communicated our support for renegotiated trade agreements such as the U.S., Mexico, Canada Agreement (USMCA) and new agreements with Japan, the EU, and others. Members of Congress have been asked to show support for the USMCA and prioritize its passage. USDA has been asked to provide greater clarity on their Market Facilitation Program as the situation surrounding international trade continues to be uncertain. The organization produced a video that was shared with multiple elected officials and appointed officials promoting the passage of the USMCA trade agreement.

Several congressional offices reached out to our organization to visit about our priorities for the 2018 Farm Bill. Our priorities were shared with each office for their consideration as the bill is drafted. Priorities include: maintaining crop insurance, revising cotton and dairy programs, and keeping the current acreage cap on the CRP program. The organization also led letters to our House and Senate delegations expressing support for passage of the farm bill, and communicated with individual offices regarding our priorities for amendments to said bill. We also contacted offices about a potential amendment to the farm bill regarding the regulatory jurisdiction over lab-grown meat. Ultimately the amendment did not transpire. Conversations have also taken place regarding USDA's Cotton Marketing Loan Program and impacts of prices on tax burdens

Regulatory Reform: This issue is a strategic priority for our organization. As such, we support the bills below: Regulatory Accountability Act (HR 5) - This bill would amend the Administrative Procedures Act (APA) to require agencies to be more open and transparent on data used to justify a rule. Regulations from the Executive in Need of Scrutiny (REINS) Act (S. 21/HR 26) - Legislation that would require Congress to vote on every new major rulemaking proposed by the Executive Branch, which has an annual economic impact of $100 million or more. The organization supports S. 21 and HR 26. The Providing Accountability Through Transparency Act (HR 77) - Legislation that would require each agency, in providing notice of a rulemaking, to include a link to 100 word plain language summary of the proposed in regulations.gov. The organization supports HR 77. The Searching For and Cutting Regulations That Are Unnecessarily Burdensome Act of 2015 (SCRUB Act; HR 998) - Legislation that would establish a bi-partisan commission to review the Code of Federal Regulations and specify rules that should be repealed based on certain criteria. The organization supports HR 998. Presidential Appointments: The organization supported the confirmation of EPA Administrator Scott Pruitt by cosigning a coalition letter. The organization has urged for the confirmation of former Georgia Governor Sonny Perdue as Agriculture Secretary. We are monitoring other USDA appointments as well as appointments to other departments/agencies such as the U.S. Army Corps of Engineers.

Of interest to the organization are funding for USDA's Agriculture in the Classroom program and provisions affecting the administration of farm and conservation programs as well as animal health, livestock and poultry marketing, and meat inspection programs. FY 2017 Energy and Water and Related Agencies Appropriations Bill: Legislation that provides funding for the Department of Energy, U.S. Army Corps of Engineers (Civil Works), Department of Interior, etc. The organization is concerned about the allocation of federal funds within the Corps' Missouri River budget between the Missouri River Recovery Program and the Bank Stabilization and Navigation Project. Other key policy provisions of interest to our organization include those pertaining to "Waters of the U.S." and the Endangered Species Act. FY 2017 Interior and Environment Bill: Legislation that provides funding for the Department of Interior, Environmental Protection Agency, Forest Service and related agencies. Of interest to the organization are provisions concerning the Waters of the U.S. final rule/Clean Water Act, Endangered Species Act, and Worker Protection Standards rule pertaining to on-farm pesticide use. FY 2017 Labor, Health and Human Services, Education and related Agencies Appropriations bill: The organization is monitoring discussions concerning the Occupational Safety and Health Administration's (OSHA) Process Safety Management of Highly Hazardous Chemicals (PSM) standard. The effect of OSHA's interpretive memorandum would be felt most significantly on establishments that sell anhydrous ammonia in large quantities, and as a result, will impact farmers' access to and price of anhydrous ammonia. The organization has encouraged dialogue between Members of Congress and OSHA officials.

Death Tax Repeal Act (S.860/H.R.1155): Legislation that would amend the Internal Revenue Code to repeal estate and generation-skipping transfer taxes. The organization opposes the estate tax and therefore supports S.860/H.R.1155. Marketplace Fairness Act of 2015 (S.698): Legislation that would allow each member state under the Streamlined Sales and Use Tax Agreement to require all sellers not qualifying for a small-seller exception to collect and remit sales and use taxes with respect to internet sales. Remote sellers with less than $1 million annual sales are excluded; those who are above the threshold would be provided software for collecting the tax. The organization supports fair competition between local and main street retailers and internet-only sellers. The House companion bill is H.R.2775, the Remote Transactions Parity Act. Farm Equipment Depreciation (S.2202/H.R.4474): Legislation to permanently reinstate five-year depreciation for farm equipment. The organization supports this change since agriculture is an equipment-heavy industry. The Protect Family Farms and Businesses Act (H.R.6100/S.3436): Legislation to prohibit the Internal Revenue Service from finalizing and implementing its proposed regulations on liquidation of an interest with respect to estate, gift, and generation-skipping transfer taxes. The organization opposes the rulemaking because it would make it more difficult for farmers and ranchers who operate family-owned partnerships, LLCs or corporations to transfer their farms and ranches to the next generation. Comments were filed during the public comment period. Biodiesel Tax Incentive Reform and Extension Act of 2016 (H.R.5240): Legislation that would extend the $1-per-gallon tax credit for biodiesel through the end of 2019 and reform the credit from a blenders credit to a producers credit for fuel using U.S. commodities. The organization supports the bill.

Reducing Regulatory Burdens Act of 2015 (H.R.897): Legislation that would amend the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Federal Water Pollution Control Act (CWA) to clarify that CWA permits are not needed when a pesticide is applied in accordance with a FIFRA-approved label. The organization is concerned about the potential for duplicative permitting requirements, thus approves of the proposed clarification. A similar bill, the Sensible Environmental Protection Act of 2015 (S.1500), is pending in the Senate. Language from this bill was offered and approved as an amendment to the Bipartisan Sportsmen's Act (S.659), which is also pending in the Senate. Crop Protection: The organization is monitoring the Environmental Protection Agencys (EPA) reviews of several agricultural crop protection products, including the herbicide atrazine. A draft ecological assessment for the herbicide was available for public comment. The organization submitted a letter along with comments from individual members in September. EPA has not responded.

Trade Negotiations: Improving market access for all U.S. agricultural commodities and products and resolving sanitary and phytosanitary trade barriers are our priorities. The organization has supported congressional efforts to urge the Obama administration to make market access and trade barrier resolution priorities as well, particularly with regard to Japan. The organization is monitoring the Trans Atlantic Trade and Investment Partnership negotiations. The organization supports the Trans Pacific Partnership (TPP) and has informed the Missouri Congressional delegation. Cuba Trade: The administration is moving to remove trade restrictions on credit and banking with Cuba as well re-establish diplomatic relations. Legislation has been introduced in Congress to help facilitate agricultural exports by loosening the requirement for cash only sales, a change the organization supports. This proposal is also being discussed as a part of the appropriations process.

Crop Insurance: A bill (S.345) to limit the premium subsidy provided by the Federal Crop Insurance Corporation to agricultural producers to $50,000 is pending in the U.S. Senate. The organization opposes the bill because changes in the federal program were considered and made during the 2014 farm bill debate. Safeguard American Food Exports Act (SAFE Act; S.1214/H.R.1942): Legislation that would prohibit the sale or transport of horses for purposes of human consumption. The organization opposes S.1214/H.R.1942. The Commodity End-User Relief Act (H.R.2289): Legislation that reauthorizes the Commodity Futures Trading Commission (CFTC) through 2019. Other provisions of the bill would allow for greater protection of customer funds held by financial entities, relax certain Dodd-Frank requirements, and limit CFTC regulation of cross-border derivatives trading. The organization supports reauthorization of the CFTC. Dairy Assistance: The organization supported congressional requests to the U.S. Department of Agriculture seeking emergency assistance for dairy farmers. More specifically, the organization supported the purchase of dairy products to be used in USDA nutrition programs and for donations to food banks.

Newhouse and Schrader to USDA expressing support for ag innovation and urging caution in making sweeping changes. Cotton: In April, USDA increased the transportation adjustment in the adjusted world price for upland cotton, which prompted questions among our members that raise the fiber crop. The organization made inquiries to select House members in an attempt to glean more insight into USDAs decision. Poultry Indemnity Program: The organization submitted comments to USDAs Animal and Plant Health Inspection Service in favor of the proposed interim rule Conditions for Payment of Highly Pathogenic Avian Influenza Indemnity Claims. House members from Missouri received a copy of the comment letter.

Health Care Reform (H.R.596): Legislation that would repeal the Patient Protection and Affordable Care Act (PPACA) and the health care provisions contained in the Health Care and Education and Reconciliation Act of 2010. The bill then would require specified committees to develop legislation addressing various issues pertaining to health care. The organization supported passage of the bill. Simplifying Technical Aspects Regarding Seasonality Act of 2015 (STARS Act; H.R.863/S.1809): Legislation to amend the Internal Revenue Code to align the definitions of seasonal worker and seasonal employee as a worker who is employed on a seasonal basis for six months or less during the calendar year for the purposes of Affordable Care Act (ACA) compliance. The organization supports the clarification to the ACA.

Corn Ethanol Mandate Elimination Act of 2015 (S.577): Legislation that would amend the Clean Air Act to revise the renewable fuel program by eliminating the annual renewable fuel standard that requires 36 billion gallons of renewable fuel to be blended into transportation fuel by 2022. The bill would not affect separate requirements for advanced biofuel, cellulosic biofuel, or biomass-based diesel. The organization opposes the bill because our member-adopted policies favor the development and use of renewable energy from feedstock produced on farm and ranch lands as part of a comprehensive national energy policy that includes traditional, renewable and alternative sources. On a related note, the organization was disappointed EPA's proposed blending requirements for biofuels fell short of those set in statute. Biofuels: The organization supports the use of advanced biofuels by the U.S. Armed Services as a means to diverse our militarys energy portfolio and provide greater operational flexibility. We are pleased with the commitment shown by the Departments of the Navy, Energy and Agriculture via a Memorandum of Understanding to expedite the development of advanced drop-in aviation and marine biofuels.

Trade Negotiations: The organization is monitoring the Trans Pacific Partnership and Trans Atlantic Trade and Investment Partnership negotiations. Improving market access for all U.S. agricultural commodities and products and resolving sanitary and phytosanitary trade barriers are our priorities. The organization has supported congressional efforts to urge the Obama administration to make market access and trade barrier resolution priorities as well, particularly with regard to Japan. The organization supported congressional action to renew Trade Promotion Authority (H.R. 1314/S. 995). Cuba Trade: The administration is moving to remove trade restrictions on credit and banking with Cuba as well as exploring re-establishment of diplomatic relations. Legislation, such as S. 491, has been introduced in Congress. The organization supports normalization of trade with Cuba. COOL: County of Origin Labeling Amendments Act of 2015 (H.R. 2393) repeals COOL requirements for beef, pork and chicken. Changes are needed in federal law and regulations as a result of a WTO ruling. The organization is concerned about trade retaliation from Canada and Mexico and is therefore supportive of this bill.

Also included is reform of prevented planting coverage, including adjustments to payment rates. The organization opposes these adjustments. Horse Slaughter: Safeguard American Food Exports Act (SAFE Act; S. 1214/H.R. 1942): Legislation that would prohibit the sale or transport of horses for purposes of human consumption. The organization opposes S. 1214/H.R. 1942. Crop Insurance: A bill to limit the level of premium subsidy provided by the Federal Crop Insurance Corporation to agricultural producers (S. 345): The organization opposes a $50,000 cap on crop insurance premium subsidies. Grain Standards: The United States Grain Standards Act Reauthorization Act of 2015 (H.R. 2088) reauthorizes federal grain weighing and inspection through FY2020. Other goals of the bill include avoiding inspection shutdowns, delegating certain inspection duties to states, and requiring USDA to make sure that export inspections are not interrupted. The Senate companion is S. 1417. The organization supports H.R. 2088/S. 1417. CFTC: The Commodity End-User Relief Act (H.R. 2289) reauthorizes the Commodity Futures Trading Commission (CFTC) through 2019. Immigration Reform: Comprehensive immigration reform is of interest to the organization because each year farmers and ranchers hire and employ approximately one million workers, some of whom are foreign-born. The organizations member-adopted policies emphasize the importance of securing our borders and enforcing existing immigration laws while also recognizing the need for a more viable worker program for agriculture. The organization opposes legislation that would mandate E-verify without providing agricultural employers access to a legal current workforce and a new temporary worker program. Secure Our Borders First Act (H.R. 399): Legislation that sets forth a number of steps to be taken by the Department of Homeland Security to improve border security. The bill is consistent with our organizations member-adopted policy that supports securing our borders by using the most technologically advanced means possible and in a way with minimal impact on agricultural producers.

FY 2016 Agriculture, Rural Development, Food and Drug Administration and Related Agencies Appropriations Bill: Legislation that provides funding for the U.S. Department of Agriculture and Food and Drug Administration. Of interest to the organization are funding for USDA's Agriculture in the Classroom program and provisions affecting the administration of farm and conservation programs as well as animal health and meat inspection programs. FY 2016 Energy and Water and Related Agencies Appropriations Bill: Legislation that provides funding for the Department of Energy, U.S. Army Corps of Engineers (Civil Works), Department of Interior, etc. The organization is concerned about the allocation of federal funds within the Corps' Missouri River budget between the Missouri River Recovery Program and the Bank Stabilization and Navigation Project. FY 2015 Agriculture, Rural Development, Food and Drug Administration and Related Agencies Appropriations Bill (H.R. 4800): Legislation that provides funding for the U.S. Department of Agriculture and Food and Drug Administration. Of interest to the organization were funding for USDA's Agriculture in the Classroom program and provisions affecting the administration of farm and conservation programs, animal health and meat inspection programs, and Packers and Stockyards Act regulations. FY 2015 Energy and Water Development and Related Agencies Appropriations Act (H.R. 4923): Measure to fund the civil works projects of the U.S. Army Corps of Engineers; the Department of the Interior's Bureau of Reclamation and Central Utah Project; the Department of Energy (DOE); and a number of independent agencies. Of specific interest to the organization was the Army Corps of Engineers' budget. The organization supported the spending prohibition for the Missouri River Ecosystem Restoration Plan (MREPP) as well as the Missouri River Authorized Purposes Study (MRAPS).

"Electricity Security and Affordability Act" (H.R. 3826): Legislation that would prohibit the Environmental Protection Agency (EPA) from establishing a performance standard for greenhouse gas emissions from any new sources that is a fossil fuel-fired electric generating unit unless specific requirements are met. The organization supports H.R. 3826. "Farmer Identity Protection Act" (S. 1343): Legislation to prohibit the EPA or any EPA contractor from releasing private and confidential information of livestock and poultry farmers to the public. The organization supports S. 1343 and a similar bill in the House of Representatives, H.R. 4157. "Waters of the U.S." Proposed Rule: The organization has serious concerns about the proposed rule issued by the EPA and Army Corps of Engineers (Corps) to define the scope of waters protected under the Clean Water Act as well as the Interpretive Rule Regarding the Applicability of Clean Water Act Section 404(f)(l)(A). Our concerns were detailed in comments submitted to the docket. "Waters of the United States Regulatory Overreach Protection Act" (H.R. 5078): Legislation prohibiting the Environmental Protection Agency and Army Corps of Engineers from developing, finalizing, adopting, implementing, applying, administering, or enforcing the proposed "Waters of the U.S." (WOTUS) rule. The bill also requires the agencies to withdraw the interpretive rule issued in partnership with the U.S. Department of Agriculture and consult with state and local officials concerning the scope of the federal Clean Water Act. The organization supports the measure. The organization submitted comments to the Environmental Protection Agency (EPA) explaining members' concerns with the "Carbon Pollution Emission Guidelines for Existing Stationary Sources: Electric Utility Generating Units" rulemaking. The organization opposes the regulation of greenhouse gases under the federal Clean Air Act.

Marketplace Fairness Act of 2013 (S. 336/H.R. 684): Legislation that would allow each member state under the Streamlined Sales and Use Tax Agreement to require all sellers not qualifying for a small-seller exception to collect and remit sales and use taxes with respect to internet sales. Remote sellers with less than $1 million annual sales are excluded; those who are above the threshold would be provided software for collecting the tax. (continued)The organization supports fair competition between local and main street retailers and internet-only sellers. Tax Reform: The organization supports replacing the current federal income tax with a system that is simple, transparent, revenue-neutral and equitable. As such, we are closely monitoring discussions in the House Ways and Means Committee and the Senate Finance Committee. Furthermore, the organization supports extending several tax provisions that lapsed at the end of 2013 (e.g. section 179 small business expensing, bonus depreciation, the cellulosic biofuel producer tax credit, etc.). The organization supports passage of H.R. 4718 which would make 50 percent bonus depreciation permanent. We support maintaining current cash accounting rules for farmers and ranchers.

Oil Spill Prevention, Control, and Countermeasures (SPCC) Rule: A regulation enforced by the Environmental Protection Agency concerning above- and below-ground storage of oil, fuel, etc. Facilities with certain quantities of oil/fuel storage must complete and implement a spill control plan to use in the event an emergency would occur. It is of interest to the organization because farms and ranches often have fuel storage areas and could therefore fall under the regulation. (continued) Renewable Fuel Standard: The Environmental Protection Agency (EPA) is proposing to reduce the Renewable Fuel Standard (RFS2) requirement for 2014 below the level set by Congress in the Energy Independence and Security Act of 2007 (EISA). The organization supports the RFS2 as passed by Congress. Keystone XL Pipeline: The organization submitted a letter in response to the U.S. State Department's public comment period for the Presidential Permit application. Marine Highway Program: The Port of Kansas City is urging the U.S. Maritime Administration, an agency within the U.S. Department of Transportation, to designate the stretch of the Missouri River between Kansas City, Missouri, and Sioux City, Iowa, as the M-29 Kansas City Connector under the Marine Highway Program. The Minnesota Department of Transportation is seeking to add an upper stretch of the Mississippi River too. Our organization supports the designations as a means to promote river navigation.

Agricultural Disaster Assistance (S. 141): Legislation that would reinstate and fund agricultural disaster assistance programs authorized under the 2008 Farm Bill. The programs covered include the Livestock Indemnity Program, Livestock Forage Program, Emergency Assistance for Livestock, Honey Bees, and Farm-raised Fish Program, Noninsured Crop Disaster Assistance Program and Tree Assistance Program. Severe drought afflicted areas of Missouri in 2011 and the entire state in 2012. (Continued)Therefore, the organization supports the bill. 2013 Farm Bill: Passage of a comprehensive, multi-year farm bill is a priority for the organization. Among other purposes, a new farm bill should strengthen the federal crop insurance program, offer a choice of safety net options within the commodity title, and reinstate disaster assistance programs for livestock producers.

Veterinary Medicine Loan Repayment Program Enhancement Act (S. 553/H.R. 1125): Legislation that would amend the Internal Revenue Code of 1986 to provide an exclusion for assistance provided to participants in certain veterinary student loan repayment or forgiveness programs. The bill is designed to increase access to veterinary care in designated shortage areas by providing academic loan repayment in exchange for service. (Continued)Loan repayment awards under this legislation and other similar state programs would be exempt from federal taxation. The organization supports the bill. Marketplace Fairness Act of 2013 (S. 336/H.R. 684): Legislation that would allow each member state under the Streamlined Sales and Use Tax Agreement to require all sellers not qualifying for a small-seller exception to collect and remit sales and use taxes with respect to internet sales. Remote sellers with less than $1 million annual sales are excluded; those who are above the threshold would be provided software for collecting the tax. The organization supports fair competition between local and main street retailers and internet-only sellers. American Taxpayer Relief Act of 2012 (H.R. 8): Legislation to extend and/or make permanent certain tax provisions enacted in 2001 and 2003. The bill also included a short-term extension of the 2008 Farm Bill, certain health care programs, and unemployment benefits. The organization did not take a position on the overall package, but supported the continuation of current gift and estate tax exclusions and several other tax provisions.

S. 175: A bill to amend the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) to clarify that the lawful application of pesticides under FIFRA does not trigger regulatory requirements in other programs such as the Clean Water Act. The organization took positions on a few amendments; among them was an amendment we supported to transfer existing agriculture funds to the Food Safety Inspection Service to ensure meat inspectors are not laid off due to sequestration. Senate Budget Resolution for FY 2014 (S. Con. Res. 8): The organization monitored amendments to the budget resolution and took positions on those pertaining to key issues of interest to our members including federal estate taxes, internet sales tax collection, and the inland waterway system. "Federal Agriculture Reform and Risk Management Act of 2012" (H.R. 6083): Legislation that sets policies and authorizes the expenditure of funds for commodity support, crop insurance, conservation, renewable energy, credit, livestock, nutrition and other programs. The organization has policy positions on many aspects of the Farm Bill, particularly regarding farm and conservation programs. (Continued)"Dairy Security Act of 2011 (H.R. 3062): A bill to repeal the existing Dairy Product Price Support Program, Milk Income Loss Contract Program, and export incentive programs, and replace them with producer margin protection and dairy market stabilization programs. The bill would also reform the Federal Milk Marketing Orders. The organization favors changes in existing dairy programs. Drought and Emergency Disaster Assistance: All Missouri counties received secretarial disaster designations in 2012 due to extreme drought. MFB communicated with the Missouri Congressional delegation and USDA concerning the impacts on farmers and ranchers and possible ways to help. Specific items of discussion included extension of livestock disaster assistance programs that lapsed September 30, 2011, release of Conservation Reserve Program acres for emergency haying and grazing, funding for the Emergency Conservation Program and the tax implications of weather-related sales of livestock. Agriculture Appropriations: The 2008 Farm Bill directed the U.S. Department of Agriculture (USDA) to make changes in the Packers and Stockyards Act relative to poultry production. Our poultry grower members support provisions pertaining to capital investments, cancellation of growing or production contracts and dispute resolution. The organization is monitoring efforts to limit or prohibit the USDA from implementing the changes specific to poultry. National School Lunch Program: The Healthy, Hunger Free Kids Act, passed by Congress and signed into law by the president in 2010, prompted the U.S. Department of Agriculture (USDA) to review nutrition standards for the National School Lunch and Breakfast Programs. USDA initiated a rulemaking process to update portion sizes and nutrition requirements for the lunch program and they were finalized in 2012. Mandatory caloric limits and limits on lean meat, protein-rich foods and dairy products are of concern to the organization, as are the lack of flexibility and added costs for local school districts.

Under current law the 15 percent rate will increase to 20 percent in 2013. Capital gains taxes have a significant impact on farming and ranching because production agriculture requires large investments in land and buildings that are held for long periods of time. (Continued)"Death Tax Repeal Permanency Act of 2011" (H.R. 1259 and S. 2242): Legislation that would repeal estate and generation-skipping transfer taxes and make permanent the maximum 35 percent gift tax rate and a $5 million lifetime gift exemption. Absent Congressional action in 2012, the top rate for the estate tax will increase to 55 percent and the exemption will decrease from $5 million to $1 million per person. The organization supports permanent estate tax relief. Expiration of Tax Provisions: The organization supported an extension of certain tax provisions that had expired or would have expired at the end of 2012. Such provisions include those relating to the production of renewable energy and Section 179 small business expensing. H.R. 2942: Legislation that would direct the Chief of the Army Corps of Engineers to revise the Missouri River Mainstem Reservoir System Master Water Control Manual to ensure greater storage capacity to prevent serious downstream flooding. FY 2013 Energy and Water and Related Agencies Appropriations Bill (H.R. 5325/S. 2465): Legislation that provides funding for the Department of Energy, U.S. Army Corps of Engineers (Civil Works), Department of Interior, etc. The organization is concerned about the allocation of federal funds within the Corps' Missouri River budget between the Missouri River Recovery Program and the Bank Stabilization and Navigation Project. FY 2013 Department of Defense Appropriations Act (H.R. 5856): Legislation that provides funding for the Department of Defense and branches of the military. Of interest to the organization are discussions regarding the Memorandum of Understanding agreed to by the U.S. Departments of Defense, Agriculture and Energy to work toward commercializing advanced "drop-in" fuels from renewable sources to diversify the military's fuel supply.

"Preserve the Waters of the U.S. Act" (S. 2245/H.R. 4965): Legislation that would prohibit the Secretary of the Army and the Administrator of the Environmental Protection Agency from finalizing the proposed guidance entitled "EPA and Army Corps of Engineers Guidance Regarding Indentification of Waters Protected by the Clean Water Act" (EPA-HQ-OW-2011-0409). The organization is concerned about an expansion of federal regulatory authority under the Clean Water Act. Senate Joint Resolution 37: A resolution disapproving the U.S. Environmental Protection Agency's (EPA) Utility Maximum Achievable Control Technology (MACT) rule. Finalized in December 2011, the rule is intended to reduce emissions of mercury and other air pollutants from electric power generating facilities. Of concern to the organization is the combined effect of EPA regulations on coal-fired electric power generation and ultimately the cost of electricity. The organization is also concerned about the impact on natural gas demand. "Farm Dust Regulation Prevention Act of 2011" (H.R. 1633/S. 1528): Legislation that would temporarily prevent the EPA from changing the national ambient air quality standard (NAAQS) for coarse particulate matter (PM10) for one year. The bill would also exempt "nuisance dust" from regulation, unless nuisance dust was found to cause serious adverse health effects and the benefits of regulation exceeded the costs. The organization is concerned about possible changes in the NAAQS for PM10 because dust is naturally-occurring, especially in rural areas and on farms and ranches.

Of particular interest to our organization are provisions in the federal highway bill applicable to farmers who haul their own commodities to market. (Continued). Our organization supported two amendments to S. 1813, the "Moving Ahead for Progress in the 21st Century (MAP-21) Act," pertaining to agricultural transportation. Similar language is included in H.R. 7, the "American Energy and Infrastructure Jobs Act." H.R. 3265: A bill to clarify the U.S. Department of Transportation's interpretation of the Hours of Service provisions of federal law as they apply to agricultural producers transporting farm commodities. Stream Bank Erosion: The erosion of stream banks is a growing concern among Missouri landowners, but they are restricted in implementing practices to slow or stop soil loss due to policies of the Army Corps of Engineers and other federal agencies. The American Farm Bureau Federation identified spending priorities to share with legislators. Of specific interest to Missouri Farm Bureau is funding for USDA's Agriculture in the Classroom program. FY 2013 Energy and Water and Related Agencies Appropriations Bill: Legislation that provides funding for the Department of Energy, U.S. Army Corps of Engineers (Civil Works), Department of Interior, etc. The organization is concerned about the allocation of federal funds within the Corps' Missouri River budget between the Missouri River Recovery Program and the Bank Stabilization and Navigation Program. FY 2013 House Budget Resolution: The organization is interested in the federal budget, and the agriculture budget in particular because the Agriculture Committee is one of six authorizing committees required to report a budget reconciliation bill by the end of April 2012.

The organization supports the bill because its purpose is to preserve the agricultural exemptions granted to farmers and ranchers by Congress in Section 404(f) of the Clean Water Act.

FY 2012 Energy and Water Appropriations Bill: The legislation provides funding for various agencies and programs under the Department of Energy, Army Corps of Engineers, Bureau of Reclamation, Nuclear Regulatory Commission, and various regional water and power authorities. The organization supported two amendments to the bill: one to continue the funding prohibition for the Missouri River Authorized Purposes Study (MRAPS) and another to defund the Missouri River Ecosystem Restoration (continued)Plan (MRERP) study. The organization opposes MRAPS and MRERP and supports efforts to eliminate federal funding. Our members believe navigation and flood control should remain the dominant purposes of the Missouri River reservoir system. FY 2012 Interior, Environment and Related Agencies Appropriations Bill: Legislation to fund the Department of Interior, EPA, and other related federal agencies. The organization took positions on several amendments regarding issues of concern to our members. The organization supported language in the underlying bill pertaining to Clean Water Act guidance, greenhouse gases and pesticide permitting. The Consolidated and Further Continuing Appropriations Act (H.R. 2112): An omnibus package containing the Fiscal Year 2012 Agriculture, Commerce/Justice/Science and Transportation/Housing and Urban Development Appropriations Bills. The organization was interested in FY 2012 funding levels for farm, conservation, rural development, food safety and other programs administered by the U.S. Department of Agriculture. The organization opposed amendments that would have altered the farm program safety net ahead of its reauthorization and supported an amendment to provide additional funding for programs to help farmers recover their land after natural disasters strike. The organization was also interested in provisions pertaining to horse processing and a rulemaking from the Grain Inspection Packers and Stockyards Administration. FY 2012 Final Consolidated Appropriations Bill: A package of three bills containing funding for federal agencies under nine Appropriations bills, including Defense, Energy and Water, Financial Services, Homeland Security, Interior/Environment, Labor/Health and Human Services/Education, the Legislative Branch, Military Construction/Veterans Affairs, and State/Foreign Operations. The package also contained a bill (H.R. 3672) that provided funding for disaster aid and recovery assistance and a bill (H. Con. Res. 94) containing offsets for the disaster funding. The organization was interested in provisions contained in the Energy and Water and Interior Appropriations bills related to the Missouri River, Clean Water Act, greenhouse gases and other issues. The organization supported additional funding for the repair of levees and other infrastructure damaged by the flood events of 2011. Farm Bill Budget Negotiations: The organization made agriculture spending reduction/savings recommendations to the Senate and House Agriculture Committees to consider as members developed a proposal to submit to the Joint Select Committee on Deficit Reduction. The organization also developed a new farm program proposal, the Strategic Risk Reduction Program, that was shared with both committees since an effort was underway to write a new farm bill to include in a deficit reduction package. The organization inquired about the status of the Agriculture in the Classroom program as part of the farm bill discussions.

"Dairy Security Act of 2011" (H.R. 3062): A bill to repeal the existing Dairy Product Price Support, Milk Income Loss Contract, export incentive programs and replace them with producer margin protection and dairy market stabilization programs. The bill would also reform the Federal Milk Marketing Orders. The organization supports the bill. (Continued). Reducing the Deficit through Eliminating Agriculture Direct Payment Subsidies (REAPS) Act H.R. 2487: Legislation to amend the Food, Conservation and Energy Act of 2008 to terminate direct payments for covered commodities and peanuts and change the Food Security Act of 1985 to limit Average Crop Revenue Election and counter-cyclical payments to growers of program commodities. The organization opposes the bill. We believe changes in the current farm program safety net should be made when the farm bill in its entirety is reauthorized. Animal Disease Traceability: The organization submitted comments to USDAs Animal and Plant Health Inspection Service (APHIS) concerning the proposed rule entitled Traceability for Livestock Moving Interstate and shared the comment letter with the Missouri Congressional delegation. The organization supports a voluntary program that will enhance animal disease control and eradication capabilities.

The Tax Hike Prevention and Business Certainty Act (S. 1647 and H.R. 3091): Legislation that would permanently extend the 15 percent capital gains tax rate. Under current law the 15 percent rate will increase to 20 percent in 2013. The organization supports S. 1647/H.R. 3091. Capital gains taxes have a significant impact on farming and ranching because production agriculture requires large investments in land and buildings that are held for long periods of time. Grain Inspection, Packers and Stockyards Administration (GIPSA) proposed rulemaking: USDA-GIPSA, at the direction of Congress in the 2008 Farm Bill, is proposing to add/revise regulations in the Packers and Stockyards Act to clarify conditions for industry compliance, specifically aimed at meat packers, live poultry dealers and swine contractors. As an organization that represents beef, pork and poultry producers, we closely follow proposals that affect livestockmarketing and prices received by farmers and ranchers.The Veterinary Services Investment Act (S. 1053): Legislation that would authorize annual appropriations for a competitive grant program for states to relieve veterinary shortage situations and support veterinary services. "Domestic Energy Promotion Act of 2011" (S. 884): Legislation that would incrementally reduce and ultimately phase out the Volumetric Ethanol Excise Tax Credit (VEETC). The bill also reduces the general rate of duty on ethanol imports, continues the tax credit for cellulosic ethanol, increases the tax credit for alternative fuel pumps and establishes a new tax credit for dual-use refueling property. (continued)Coburn-Feinstein ethanol amendment: An amendment was offered to S. 782, the Economic Development Revitalization Act of 2011, to eliminate the VEETC on June 30, 2011, and remove the current tariff on imported ethanol. The organization opposed the amendment. McCain amendment: An amendment was offered to S. 782 to prohibit the use of federal funds to build ethanol blender pumps or storage facilities. The organization opposed the amendment. The Ethanol Reform and Deficit Reduction Act (S. 1185): Legislation that would end the VEETC and tariff on imported ethanol prior to December 31, 2011, the current expiration date. Savings generated will be used to keep in place the small ethanol producer tax credit, cellulosic production tax credit and blender pump and alternative fueling infrastructure tax credit. The remaining funds will be applied toward deficit reduction. The organization supports S. 1185. S. 700/H.R. 1747: Legislation to provide a five-year depreciation for agricultural equipment. Five-year depreciation was allowed for one year, 2009, but the provision was not extended by Congress in 2010. S. 700/H.R. 1747 would permanently reinstate the tax provision.

"Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010": A bill to extend emergency unemployment benefits and extend for two years tax measures that expired at the end of 2009 and those scheduled to expire at the end of 2010. The bill is of interest to the organization because of provisions dealing with estate taxes, capital gains taxes, income taxes, Alternative Minimum Taxes, and others that affect farm and ranch families. "The Small Business Paperwork Mandate Elimination Act" (S. 3578/H.R. 5141): Legislation to amend the Internal Revenue Code to repeal a provision included in the "Patient Protection and Affordable Care Act" that extends to corporations that are not tax-exempt (including farms, ranches and small businesses) the requirement to report payments of $600 or more. The organization supports repeal of the mandate because tax-related paperwork and compliance are already major expenses for agricultural operations and businesses. Estate Tax Reform: The organization supports enactment of legislation to reform the federal estate tax before the pre-2001 exemption level and tax rate are reinstated in 2011. The organization favors increasing the exemption to $5 million (and adjusting it for inflation) and reducing the maximum rate to 35 percent until full, permanent repeal is achieved. "The Small Business Paperwork Mandate Elimination Act" (S. 3578/H.R. 5141): Legislation to amend the Internal Revenue Code to repeal a provision contained in the "Patient Protection and Affordable Care Act" that extends to corporations that are not tax-exempt (including farms, ranches and small businesses) the requirement to report payments of $600 or more. "The Preservation of Antibiotics for Medical Treatment Act of 2009" (S. 619/H.R. 1549): Legislation to preserve the effectiveness of medically important antibiotics used in the treatment of human and animal diseases. Of interest to the organization are proposed restrictions on antibiotics approved by the Food and Drug Administration (FDA) for use in livestock and poultry production. FDA Draft Guidance 209 "The Judicious Use of Medically Important Antimicrobial Drugs in Food-Producing Animals": The organization filed comments during the formal comment period stating our opposition to restrictions on antibiotic use based on unscientific claims. Mandatory Price Reporting Act of 2010 (S. 3656/H.R. 5852): Legislation to amend the "Agricultural Marketing Act of 1946" to: (1) extend reporting requirements for livestock daily markets through September 30, 2015; (2) establish mandatory reporting for wholesale pork cuts and exports; and (3) direct the Secretary of Agriculture to establish an electronic price reporting system for dairy products. The organization supports reauthorization of mandatory price reporting to provide greater market transparency for livestock producers. Grain Inspection, Packers and Stockyards Administration (GIPSA) proposed rulemaking: USDA-GIPSA, at the direction of Congress in the 2008 Farm Bill, is proposing to add/revise regulations in the "Packers and Stockyards Act" to clarify conditions for industry compliance, specifically aimed at meat packers, live poultry dealers and swine contractors. As an organization that represents beef, pork and poultry producers, we closely follow proposals that affect livestock marketing and prices received by farmers and ranchers.

"Continuing Chemical Facilities Antiterrorism Security Act of 2010" (S. 2996): Legislation to amend the "Department of Homeland Security Appropriations Act (2007)" to extend for five years the authority of the Secretary of Homeland Security (DHS) to issue interim final regulations establishing risk-based performance standards for security of chemical facilities and requiring vulnerability assessments and the development and implementation of site security plans for such facilities (known as the Chemical Facility Antiterrorism Standards program). The Chesapeake Bay Program Reauthorization and Improvement Act (H.R. 5509): Legislation to modify the Chesapeake Bay Program under the Clean Water Act, establish an independent commission to oversee and administer a nutrient and sediment trading program for Chesapeake Bay States, establish a Chesapeake Bay watershed pilot program for creating environmental service markets, and other purposes. Of interest to the organization is the proposed approach to addressing water quality issues and the potential for similar actions in watersheds outside of the Chesapeake Bay. "Draft National Pollutant Discharge Elimination System (NPDES) Pesticide General Permit (PGP) for Point Source Discharges from the Application of Pesticides": The EPA issued the PGP in response to the 6th Circuit Court of Appeals decision to vacate an EPA rule exempting from NPDES permitting pesticide applications made to or over, including near, waters of the U.S. according to label requirements of the "Federal Insecticide, Fungicide and Rodenticide Act (FIFRA)." The organization submitted comments detailing concerns about the PGP. H.R. 6087/S. 3735: Legislation to clarify that lawful application of pesticides under the FIFRA does not trigger regulatory requirements in other programs. The organization supports the bill because it reaffirms the purpose of FIFRA and as a result pesticides applied to or near water, in accordance with the FIFRA label, would not be considered a pollutant under the "Federal Water Pollution Control Act (also referred to as the Clean Water Act or CWA)." H.R. 6273: Legislation to amend the FIFRA and CWA to prohibit the Environmental Protection Agency (EPA) from requiring additional permits for pesticides when applied consistent with FIFRA. H.R. 6273 is similar to H.R. 6087.

FY 2010 Agriculture Appropriations Bill - A bill making appropriations for Agriculture, Rural Development, Food and Drug Administration, and Related Agencies. Of interest to the organization are provisions pertaining to poultry trade with China, Agriculture in the Classroom program, conservation programs, etc. Also of interest is the removal of the 2009 Omnibus Appropriations limit on Section 32 expenditures so that additional purchases of surplus meats, poultry, dairy products, fish, fruits and vegetables can be made by the U.S. Department of Agriculture (USDA) to benefit those in need. In the context of helping pork and dairy producers struggling through extremely low market prices, the organization urged the Missouri Congressional delegation to work with the USDA in exploring options for assistance.

Clean Water Restoration Act - Legislation introduced in the 110th Session of Congress to expand the Federal Water Pollution Control Act to clarify the jurisdiction of the United States over waters of the United States. Environmental Protection Agency Advance Notice of Proposed Rulemaking: Regulating Greenhouse Gas Emissions under the Clean Air Act. In response to the U.S. Supreme Court's decision in Massachusetts v. EPA, the Agency prepared and released for public comment the ANPR. Issues of interest are the potential impacts of such regulation on farm and ranch operations and the cost of fuel, fertlizer and othe agricultural inputs. S. 527/H.R. 1426: Bills to amend the Clean Air act to prohibit the issuance of permits under Title V of that Act for certain emissions from agricultural production. H.R. 1438: Legislation to prohibit any Federal agency or official, in carrying out any Act or program to reduce the effects of greenhouse gas emissions on climate change, from imposing a fee or tax on gaseous emissions emitted directly by livestock.
