  • Work to modify or repeal CMS authority to apply the Medicare Secondary Payer Act to liability claims.
  • Work in support of amendments to improve remedies and insurance coverage under DOHSA, highway safety, maritime and aviation laws. Work in opposition to amendments that would reduce or eliminate the remedies available to foreign seamen under U.S. law. Work to limit preemptive effects of legislation authorizing and establishing rules governing the introduction of autonomous vehicles in the 50 states. Work on H.R.2, Moving Forward Act, in support of proposals to increase minimum insurance requirements for over the road truckers and in opposition to liability limitations for broker shippers.

  • Work on cybersecurity and data sharing legislation to narrow the preemptive effect of such legislation. Work legislation that would require mandatory reporting of cyber incidents, including S.2407 - Cyber Incident Notification Act of 2021, and H.R.5440 - Cyber Incident Reporting for Critical Infrastructure Act of 2021, to ensure that reporting of such incidents does not provide liability relief to reporting parties.
  • Work in opposition to cyber security legislation, which would expand the definition of firms eligible for liability relief under existing law.
  • Work on H.R.5376, Build Back Better Act, in support of tax provision that would enable attorneys to deduct litigation expenses in the calendar year in which such expenses are incurred.
  • Work on H.R.4521, America COMPETES Act of 2022, and the House Senate Conference to ensure that corporate supply chain information voluntarily submitted to the Commerce Department supply chain program remains subject to discovery in unrelated proceedings.
