Issue:

Based on staff interview and record review, the facility failed to maintain the privacy and confidentiality of one patient (Patient A) when an employee working in the emergency room inadvertently gave Patient A ' s discharge instructions to another patient.Findings:A telephone interview was conducted on 1/9/12 at 2:00 PM, with the Facility ' s Information Privacy Officer (IPO). The IPO stated that on 12/26/11, an employee working in the emergency room inadvertently gave Patient A ' s discharge instructions to another patient. The IPO stated that both patients had the same last name.The IPO further stated that Patient A became aware of the incident when he inquired why it was taking so long to receive his discharge instructions.Review of the information that was disclosed in error to another patient included the following personal health information (PHI): Patient name Date of birth Diagnosis Age Physician Discharge instructionsThe IPO stated that the other patient was sent a letter to verify if the wrong information was given. The IPO stated the other patient brought the personal information back. The IPO stated that the employee was disciplined.
