Issue:
Based on interview and record review the facility failed to inform the patient of the unauthorized access of patient's medical information no later than five business days after the unauthorized access of the information.Findings:In an interview on 1/15/14 at 1:00 PM Privacy Analyst 2 (PA2) stated that on 10/15/13 a consult letter was faxed to the incorrect healthcare provider. PA2 said that the facility was aware of the unauthorized access of protected health information (PHI) on 10/22/13.Record review indicated letter dated 11/5/13 informing patient of the unauthorized access of PHI. The notification to the patient affected by the medical information breach occurred seven days after the five business days required by the regulations.
