Issue:

Based on interview and record review the facility failed to notify the California Department of Public Health of the breach of personal patient health information within the five business days after discovery.Findings:In an interview on 1/15/14 at 1:00 PM Privacy Analyst 2 (PA2) stated that on 10/15/13 a consult letter was faxed to the incorrect healthcare provider. PA2 said that the facility was aware of the unauthorized access of protected health information (PHI) on 10/22/13.Record review indicated letter dated 11/6/13 informing CDPH of the unauthorized access of PHI. The notification to CDPH affected by the medical information breach occurred eight days after the five business days required by the regulations.
