Issue:
Based on interview and documents review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) was not disclosed to an entity not authorized to receive the information. Findings:On March 12, 2012, an investigation regarding unauthorized disclosure of Patient A's PHI was conducted. On May 15, 2013, at 9:58 a.m., a follow up phone call was made to the facility. A phone interview with the Executive Secretary (ES) was conducted. The ES stated on February 2, 2012, an employee unintentionally faxed Patient A's laboratory results to Physician 1 instead of Physician 2. Physician 1's office staff called the hospital's Laboratory Department to report receiving Patient A's laboratory results wrongfully on February 3, 2012. Physician 1's office staff shredded the documents afterwards. On May 15, 2013, a review of facility documents included:a. Patient A's laboratory result forms. The PHI included Patient's name, date of birth, sex, medical record number, Fin number (account number), and the result of the test. b. Two letters addressed to Patient A, dated February 10 and February 24, 2012, indicated the facility notified Patient A of the privacy breach.
