Issue:
Based on interview and documents review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) was not disclosed to an entity not authorized to receive the information. Findings:On March 12, 2012, an investigation regarding unauthorized disclosure of Patient A's PHI was conducted. On May 15, 2013, at 9:53 a.m., a follow up phone call was made to the facility. A phone interview with the Executive Secretary (ES) was conducted. The ES stated on January 11, 2012, an employee faxed Patient A's laboratory results to the number of the laboratory requisition form instead of the Physician's fax number. The facility's Laboratory Services received a call from a staff of another hospital, stated that Patient A was not their patient there. The staff of another hospital stated they would shred Patient A's documents. On May 15, 2013, a review of facility documents included:a. The "Laboratory Requisition" form of Patient A. The PHI included Patient's name and date of birth. b. The laboratory result form of Patient A. The PHI included Patient's name, date of birth, sex, medical record number, Fin number (account number), and the result of the test. c. A letter addressed to Patient A, dated January 18, 2012, indicated the facility notified Patient A of the privacy breach.
