Issue:

Based on interview and record review, the facility failed to ensure the confidential treatment of protected health information (PHI) for Patient A, whose laboratory results were given to Patient B, who was being discharged from the unit.FindingsOn 7/10/12 at 2:00 PM, an unannounced visit was made to the facility to investigate a entity-reported incident of a possible breach of PHI.During an interview with the facility privacy officer (FPO) he stated, " On 6/18/12, the nurse was in the process of discharging patients. She grabbed Patient A's lab work and included it with the paperwork for Patient B. The husband of Patient A discovered the error when they got home and contacted us. Our staff went and retrieved the data, and provided Patient A with the correct laboratory results. I then sent a letter to Patient A and notified her of the mix-up in paperwork."A review of the paperwork that had been provided in error was done. There were four pages of laboratory results for Patient B. The paperwork contained his name, account number, age, date of birth, doctor's name, the type of lab work being done, and the results.A review of the letter sent to Patient B dated 6/22/12, acknowledged that a breach of PHI had occurred.
