Issue:
A bargain employee receives a 5 days suspension, but he submits a grievance to a appeal it and a quasi-judicial process is held in VA premises. One of the witnesses that was being interviewed about a fact finding she had performed in the past with this employee, is required by the employees attorney to present the documents that she used for such fact finding. The employee brings her documentation during her interview session and gives it to the following individuals: bargain employee, attorney of the bargain employee (outside VA), Union President, VAs attorney (Regional Counsel), HR Labor Relations employee and the arbitrator (who is an attorney from a pool of arbitrators selected by the FLRA, paid by both parties : VA-employee). Among the fact findings documents, a Federal Employees Notice for Traumatic Injury and Claim for Continuation of Pay/Compensation (CA-1) form was found with no relation to the case. This form was filled with the bargain employees PII (Full name, full DOB, full SSN, Home Telephone and Occupation Title) and was inadvertently disclosed to all the people in the room. Update: 04/25/12:Veteran A will be sent a letter offering credit protection services.
Outcome:
The Deputy Director reported taking appropriate disciplinary actions with the employee.
