Issue:

Based on documentation and interview, hospital staff failed to implement a patient's right to confidential treatment of a patient record regarding his care in the hospital.Findings:In an interview with the hospital privacy officer on 5/21/12, a staff member sent the wrong discharge paperwork with a patient (Patient A) being transferred to another facility on 2/23/12. The receiving facility notified the hospital of the error on 3/2/12. According to the privacy officer, the paperwork consisted of Patient B's informed consent for medications, conditions of admission, seclusion and restraint information and legal status.Documentation regarding the incident was reviewed on 5/21/12 and indicated that a treatment coordinator in the hospital's psychiatric unit had inadvertently mixed up papers for Patient A, which included Patient B's protected health information.
