Issue:

Based on interview and medical record review the hospital failed to prevent unauthorized access of a Patient A's medical information. Patient A's protected health information (PHI) was accessed by a relative, a hospital employee, not involved in the care of the patient. Findings:The hospital notified the Department on 8/6/12, a breach of Patient A's information was discovered on 8/1/12. On 9/18/12 at 0915 hours, an interview was conducted with the hospital's Compliance Officer. The Compliance Officer an employee of the hospital accessed the hospital's computer to review a relative's laboratory reports in the electronic medical record after the relative was seen in the Emergency Department. The Compliance Officer stated the matter was also referred to the hospital's Human Resource Management Division for further action.
