Issue:

Based on interview and record review the hospital failed to prevent unauthorized access to the protected health information (PHI) of thirty one patients when a hospital employee took patient documents home and forgot to return them to the hospital. The information contained in the records has the potential to be used illegally.Findings:The hospital notified the Department on 8/24/12, a breach of 31 patients' confidential information had occurred.The Hospital Compliance Officer was interviewed on 9/18/12 at 0900 hours. The Compliance Officer stated a hospital employee took home the financial applications of 31 patients by mistake and did not return them, but left them on top of a pile of boxes in her home. The employee stated her daughter mistakenly picked up the documents and placed them her car. The Compliance Officer stated once the daughter of the employee realized what the documents were, she placed them under the seat of the car. The Compliance Officer stated the daughter's boyfriend was arrested driving the daughter's automobile and the documents were discovered by the arresting officer. The Compliance Officer stated a detective notified the hospital and returned the documents to the hospital.
