Issue:

Based on interview and record review, the facility failed to ensure Patient B's Protected Health Information (PHI) was not given to Patient A. This failure resulted in the unauthorized disclosure of Patient B's PHI, which created the potential for unauthorized use.Findings:On November 9, 2011, at 11:30 a.m., an unannounced visit was made to the facility to investigate a breach of PHI. In a concurrent interview with the Compliance and Privacy Officer, she stated Patient A had made a visit to the Emergency Department on October 25, 2011. Patient A received a document for Patient B. The document that Patient A received, contained Patient B's name, date of birth, age, gender, medical record number, and lab results. Patient A called the Medical Records Department, on November 4, 2011, to notify them she had received the PHI for Patient B.On November 9, 2011, the facility policy and procedure titled, "Breach of Patient Privacy: Reporting Requirements," was reviewed. The policy revealed, "...Breach: The unauthorized acquisition, access, use, or disclosure of patient protected health informatiion (PHI) that compromises the security or privacy of the PHI..."
