Issue:

On 08/14/14 at 5:03 PM, CCC for the Community Living Center (CLC) sent the Privacy Officer (PO) an e-mail and PO didn't open this e-mail until 08/15/14 at 8:08 AM. The e-mail read that she just received a verbal report from an LPN on 6th floor informing her of a privacy issue. Veteran A is a new resident on the 6th floor who is also an uncle to Ward Clerk on 4B. Ward Clerk on 4B is not his Medical Power of Attorney (MPOA) nor is it listed anywhere in his chart that the family has approved us to release medical information to the Ward Clerk on 4B. The Ward Clerk on 4B just informed LPN on 6th floor that she had her "friend" RN who works in the Adult Day Health Care (ADHC) (not a nurse on the CLC) look at Veteran's CPRS record for information. She said she is unsure if Ward Clerk on 4B has been in his record but neither the Ward Clerk nor RN on ADHC have any needs or rights to be in his medical record. This is a very serious issue and feel that it needs addressed immediately. She is covering for G&EC SL Chief this week and she needs guidance as to how to proceed if there is anything she needs to do. In addition RN on 4B sent email dated 08/14/14 at 4:55 PM. and PO opened this e-mail on 08/15/14 at 8:10 AM that 4B Ward Clerk has looked into the medical records of Veteran, a resident on CLC 6th floor inquiring about his medical treatments. The resident's MPOA is a son of Veteran. We will not disclose medical information concerning any resident. She needs to be informed only the MPOA has the legal authority to inquire about the Veteran's care or treatment. Please remind RN on ADHC and Ward Clerk on 4B this is an invasion of the resident's medical records. This RN was informed by LPN on 6th floor that when going into this Veteran's room, she informed the family that per their request the doctor has ordered Veteran an enema even though he just had a bowel movement on 08/13/14. Ward Clerk on 4B then told her that she just had RN on ADHC look in CPRS today and he said he hasn't had a bowel movement since the 08/12/14. She informed 4B Ward Clerk that we document our bowel movements in care tracker and not in CPRS.

Outcome:

09/03/14: The Incident Resolution Service Team has determined that the Veteran will be sent a HIPAA notification letter due to Protected Health Information (PHI) being disclosed.
