Issue:

Based on staff interview and facility document review, the facility failed to prevent unauthorized access of Patient 1's health information when a grievance resolution letter was sent to the wrong address.Findings:There Department of Public Health received a self report dated 5/7/13 via Email that the facility detected a potential Breach of Patient Health Information (PHI).During an interview with the Privacy Officer (PO) on 10/16/13, at 10:20 a.m., she stated Patient 1's grievance letter with resolution was sent to the wrong address. PO revealed the following information was in the grievance letter:A. Case number with resolution date; andB. Grievance response from Patient Relations regarding the gastronomy tube (a tube surgically placed into the stomach for liquid nutrition) placement.During a review of the facility letter document, dated May 7, 2013, indicated the Breach happened and the facility informed the Department and Patient 1 within the specified time frames.
