Issue:
The compliance officer reported to the privacy officer that in an audit of a Veteran's (who use to work for this facility) record it was found that his wife, now ex-wife, was getting into his record and treating the Veteran. Upon review of the sensitive patient access record, it was determined that the Veteran's ex-wife had got into his record over 50 times with a little less than half being times that there are no documentation for her being in the record. The supervisor will be contacted and the ex-wife will explain the reasons why she was in her ex-husband's record besides the time she was treating him. Also, it will be explained to her that per policy, employees do not treat family members at this facility. At this time, the Veteran has not complained about this.
Outcome:
02/19/14: The Incident Resolution Team has determined that the Veteran will be sent a HIPAA notification letter due to Protected Health Information (PHI) being inappropriatley accessed.
