Issue:
Based on interview and record review, the facility failed to protect the confidential protected health information (PHI) for Patient A. This resulted in Patient A's PHI being sent by facsimile (fax) to the wrong number by the case manager . This breach included Patient A's name, age, date of birth, social security number (SSN), medical record (MR) number, diagnoses and physician's progress notes.Findings:On 4/9/12 at 11:30 AM, an investigation was made regarding an entity reported incident of a possible breach of PHI for Patient A.On 3/21/12, the case manager was faxing Patient A's information to coordinate his continued care after discharge from the psychiatric unit. The case manager inadvertently faxed to the wrong number. Patient A's PHI included his face sheet with his demographics: name, address, age, date of birth, medical record and social security numbers, and diagnoses. A copy of Patient A's history and physical, physician progress notes, and a copy of his XXXXXXX were also faxed.On 4/9/12 at 1:00 PM, the corporate compliance specialist was interviewed and stated that when the case manager was trying to coordinate Patient A's continuity of care, the faxed information had been sent to the wrong number. She acknowledged that this was a breach of Patient A's PHI.
