Issue:

Based on interview and record review, the facility failed to protect Patient A's medical information. This breach caused Patient A's protected health care information to be released.Findings:The facility self reported to the Department on 10/25/11 that a basic lab result was faxed and sent incorrectly. During a telephone interview with the Privacy Officer on 11/2/11 at 1:45 PM, he stated that a basic laboratory test result was faxed and sent incorrectly to the wrong individual. Review of the letter sent to Patient A, indicated that a copy of Patient A's "Basic lab results were inadvertently disclosed."During a follow-up telephone interview with the Privacy Officer on 3/15/12 at 8:30 AM, the Privacy Officer confirmed and stated that the phone number was a long distance number, but when the number was entered the number "1" was left out, therefore it went to a local number. The clinical record for Patient A was reviewed on 3/15/12. The following healthcare information was released:a. Name.b. Account Number.c. Age.d. Sex.e. Birth Date.f. Laboratory results.The policy and procedure titled "Faxing of Medical Records" (Policy No. A.FI) under Procedure # 8 indicated, "Manually entering a fax number is not authorized."
