Issue:

Based on interview and record review, the facility failed to notify patients and/or their legal guardians of the breach of their medical information within the required five business days after discovery.Findings:In an interview on 1/6/12 at 10:00 AM, the Director of Regulatory Affairs (DRA) stated that a camera and medical records containing personal medical information were stolen on 11/5/11. This theft was reported to city police and the facility on 11/5/11. The DRA said the camera was retrieved on 11/7/11 and the medical records were retrieved on 11/8/11. The DRA stated the six adult patients and the parents of the eight pediatric patients were notified of the breach of their medical information by letters on 11/15/11. Record review of the report to the California Department of Public Health (CDPH) faxed on 11/18/11, included copies of the letters sent by the Department of Dermatology to the 14 patients and the legal guardians, all of which were dated 11/15/11. The notification to those affected by the medical information breach occurred seven business days after the discovery of the breach rather than the five business days required by the regulations.
