Issue:
Based on interview and record review, the facility failed to notify the California Department of Public Health (CDPH) of the breach of personal patient health information within the required five business days after discovery.Findings:In an interview on 1/6/12 at 10:00 AM, the Director of Regulatory Affairs (DRA) stated that a camera and medical records containing personal patient health information and pictures were stolen on 11/5/11; the theft was reported to the facility that same day. The DRA said the camera was retrieved on 11/7/11 and the medical records were retrieved on 11/8/11. The DRA stated the six adult patients and the parents of the eight pediatric patients were notified of the breach of their medical information by letters on 11/15/11. The DRA stated she thought CDPH had been notified within the required time frame. Record review of the report to the CDPH notifying them of the breach of personal patient health information indicated it was faxed on 11/18/11. The facility was 3 days late in reporting the information breach to CDPH.
