Issue:

Based on staff interview and record review, the facility failed to maintain the privacy and confidentiality for one patient (Patient A) when an employee inadvertently pulled the wrong chart and sent Patient A ' s information to the wrong patient.Findings:An interview was conducted on 5/17/12 at 3:00 PM with the facility ' s Privacy Officer (PO). The PO stated that on 4/30/12 he was made aware of a breach incident. The PO stated that on 4/30/12 and employee pulled the wrong chart which had the same last name and similar first name as Patient A. The PO stated that the employee pulled the wrong chart and did not verify the name. The PO further stated that the employee sent Patient A ' s medical information to another patient.Record review on 5/17/12, of the information the employee sent disclosed the following personal health information (PHI): Patient name Medical imaging report Lab results Patient notesThe PO further stated that the facility became aware of the breach when the patient who received the wrong information brought the paperwork back to the facility. The PO stated that Patient A was notified of the breach.
