Issue:

On 02/19/15 at approximately 11:00 AM, the BVAMC Equal Employment Opportunity (EEO) Manager stopped by to let the Privacy Officer (PO) know that the Lab Supervisor had faxed information to an EEO Investigator on 02/17/15 that had protected health information (PHI) and personally identifiable information (PII) on 3 Veterans: Veteran A: full name, full SSN, procedure, medications, vitals, and diagnoses. Veteran B: full name, full SSN, home telephone number, and date of birth. Veteran C: full name, full SSN, and phone number. The EEO Manager indicated to the PO that the Lab Supervisor should have given the data to her to send to the EEO Investigator. In an e-mail string that the EEO Manager provided it states: 02/17/15 from EEO Manager to Lab Supervisor: "Did you have a chance to get the information requested for the EEO Investigator? I need to get that out to her ASAP." On 02/17/15 response from Lab Supervisor to EEO Manager: "I sent EEO Investigator more emails today and two separate faxes with several documents each. I hope she has all she needs from us, but if not she will let us know." On 02/18/15 response from EEO Manager to Lab Supervisor: "Thank you. Please make sure you get me a copy of everything you sent as well so I have it. You can put it in a security envelope and slide it under my door. Thank you." On 02/18/15 response from Lab Supervisor to EEO Manager: "I will drop off later." PO informed the EEO Manager to call the EEO Investigator and tell her to please shred the documents that the Lab Supervisor sent her. PO will redact the same documents and forward them to the EEO Manager on 02/19/15 in order for EEO Manager to send to the EEO Investigator.

Outcome:

02/19/15: The Incident Resolution Service Team has determined that three Veterans will be sent a letter offering credit protection services.
