Issue:

Based on review of hospital documents and interview, the hospital failed to protect the PHI belonging to Patient Z disclosure to an unauthorized individual. In addition, the hospital failed to notify Patient Z of the breach of PHI within five business days of the hospital's knowledge of its occurrence.Findings: Hospital documents showed Patient Z was a hospital employee. Documentation showed, on 5/25/11, Patient Z's manager spoke with the patient/employee's personal physician concerning the patient's PHI. The PHI disclosed included the patient's medical condition and work status. The hospital was made aware of the breach concerning Patient Z on 5/25/11. Patient Z was not notified of the breach of PHI until 6/10/11.On 4/6/12 at 0930 hours, during a telephone interview the Manager of Regulatory Compliance verified the above reported breach and the dates.
