Issue:

Based on interview and document review, the facility failed for one patient (Patient A), to ensure that (PHI) Protected Health Information was not disclosed to any entity not authorized to receive the information. This failed practice resulted in unauthorized access to Patient A's demographic information and medical records.Findings:On September 10, 2012, unannounced visit was made to the facility to investigate a breach of PHI. On September 10, 2012, at 12:15 p.m., interview was conducted with the Compliance Officer. The Compliance Officer stated the lab technician sent Patient A's lab results to the wrong physician's office. The lab technician entered the wrong physician's phone number. When the lab results were received, a staff member at the physician's office called EMC to report they had received medical records for a person who was not their patient. The Compliance Officer stated, as a result of this breach, their policy and procedures were changed. The new policy will require a second person verify the fax number before sending any medical records by fax.The facility failed for Patient A, to ensure Protected Health Information was not disclosed to any entity not authorized to receive the information, resulting in unauthorized access to Patient A's lab results and demographic information.
