Issue:

Based on interview and document review, the facility failed for one patient (Patient A), to ensure that (PHI) Protected Health Information was not disclosed to any entity not authorized to receive the information. This failed practice resulted in unauthorized access to Patient A's demographic information and medical records.Findings:On September 10, 2012, a visit was made to the facility to investigate a breach of PHI.An interview was conducted with the Compliance Officer on September 10, 2012, at 1:30 p.m. The Compliance Officer stated the physician dialed the wrong number when attempting to fax mammogram results to Patient A. Instead the results were sent to a storage company. The storage company notified the facility about receiving the protected health information.The facility's policy and procedure titled, "Faxing Protected Health Information," was reviewed. The policy indicated, "All Protected Health Information sent or received by EMC shall be protected in a manner that protects against unauthorized disclosure of such records to third parties...Reconfirm the destination fax number prior to transmission by checking the telephone number displayed on the fax machine screen before transmitting it..."
