Issue:
Based on interview and document review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) were not disclosed to an entity not authorized to receive the information. As a result, Patient B received Patient A's PHI. Findings:On November 29, 2012, at 11:05 a.m., the facility's Director of Compliance, Law Department (DOC) was interviewed by phone. The DOC stated on November 19, 2012, Patient A's name and medical record number were printed on the copies of discharge instructions given to Patient B. The content of the discharge instructions were meant for Patient B. Patient B returned the copies of discharge instructions to the facility and were destroyed. On November 29, 2012, a review of facility documents included:a. Copies of discharge instructions. The PHI included Patient A's name and medical record number. b. A letter addressed to Patient A, dated November 27, 2012, indicated the facility notified Patient A of the privacy breach.
