Issue:

Based on interview and document review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) were not disclosed to an entity not authorized to receive the information. Findings:On November 29, 2012, at 11:15 a.m., the facility's Director of Compliance, Law Department (DOC) was interviewed by phone. The DOC stated on November 15, 2012, Patient A's ultrasound report was sent to an incorrect medical facility by error. The staff entered the wrong fax number in the auto fax. The DOC stated the medical facility contacted the facility about the error on November 15, 2012. Patient A's ultrasound report was shredded by the medical facility. On November 29, 2012, a review of facility documents included:a. The ultrasound report of Patient A. The PHI included the Patient's name, address, phone number, date of birth, age, and result of the ultrasound. b. A letter addressed to Patient A and her parent, dated November 21, 2012, indicated the facility notified Patient A and her parent of the privacy breach.
