Issue:
Based on interview and hospital document review, the hospital failed to prevent the posting of Patient D's protected health information (PHI) on a social network. Additionally, the hospital failed to notify the Department of the breach of PHI within five business days.Findings:Review of hospital documentation showed on or about 11/13/11, a staff member posted the PHI of Patient D on a social media website (Facebook) and was available to an unknown number of unauthorized individuals. The hospital's investigation showed Patient D's disclosed PHI included name, date of birth, hospital room number and medical record number, account number and physician's name.The hospital became aware of the breach of Patient D's PHI on 12/13/11; however, the breach was not reported to the Department until 1/5/12.On 9/16/14 at 0930 hours, a conference call with the Interim Director of the Health Information Management Department confirmed the breach of PHI occurred as documented.
