Issue:

Based on interview and hospital document review, the hospital failed to prevent the disclosure of Patient C's protected health information (PHI) from an unauthorized entity. In addition, the hospital failed to notify the patient and the Department within five business days of their knowledge of the breach of PHI.Findings:Review of hospital documentation showed on 12/12/11, the hospital became aware a breach of Patient C's PHI occurred. On 12/8/11, a radiology staff inadvertently faxed the computerized tomography scan of Patient C's abdomen and pelvis to the wrong healthcare company.Patient C's disclosed PHI included name, date of birth, medical record number and date of service. Additionally, the ordering and reading physicians' names with the test results were disclosed.The hospital was aware of the breach of PHI on 12/12/11. The patient was notified by certified mail dated 1/3/12, and the Department was notified on 1/5/12.On 9/16/14 at 0930 hours, a conference call with the Interim Director of the Health Information Management Department confirmed the breach of PHI occurred as documented.
