Issue:
Based on interview and hospital document review, the hospital failed to prevent the disclosure of Patient A's PHI (protected health information) to an unauthorized entity. Additionally, the hospital failed to report the unauthorized disclosure to the Department within five business days.Findings:Review of hospital documentation showed Patient A's PHI was inadvertently faxed to a loan company on 7/14/11. The hospital's investigation showed a staff member received the intended fax number from the Roladex; however, when dialing the fax number the staff dialed incorrectly.The hospital was made aware of this breach of PHI on 7/18/11. The letter reporting the breach of PHI to the Department was dated 7/22/11; however, the letter was not received by the Department until 8/5/11. On 9/16/14 at 0930 hours, a conference call with the Interim Director of the Health Information Management Department confirmed the breach of PHI occurred as documented.
