Issue:
Based on interview and record review, the facility failed to ensure Patient A's protected health information (PHI) was faxed to the correct physician's office. This failure resulted in the unauthorized disclosure of Patient A's PHI, which created the potential for unauthorized use.Findings:On April 30, 2012, at 11:30 a.m., a telephone call was made to the Compliance Specialist. The Specialist stated a breach of Patient A's PHI was discovered, on April 19, 2012. Information containing Patient A's name, date of birth, age, medical record number, account number, treatment information, medical history, and a screening examination were faxed to the incorrect physician's office. A fax was returned to the outpatient facility from the incorrect physician, notifying the facility they did not have Patient A in their system.On April 30, 2012, the facility policy and procedure titled, "HIPAA (Health Insurance Portability and Accountability Act) - Use and Disclosure of Protected Health Information," was reviewed. The policy indicated, "...Policy: It is the policy of Eisenhower Medical Center that the confidentiality of Protected Health Information contained in records and collected pursuant to treatment will be protected to the fullest extent possible..."
