Issue:

Based on interview and record review, the facility failed to ensure discharge documentation for Patient A was not given to Patient B. This failure resulted in the unauthorized disclosure of Patient A's protected health information (PHI), which created the potential for unauthorized use.Findings:On April 30, 2012, at 11:15 a.m., a telephone call was made to the facility to the Compliance Specialist. The Specialist stated on April 19, 2012, discharge instructions for Patient A were given to Patient B. The instructions included Patient A's name, medical record number, account number, date of birth, age, sex, medications, diagnosis, and visit highlights.On April 30, 2012, the facility policy and procedure titled, "HIPAA - Use and Disclosure of Protected Health Information," was reviewed. The policy indicated, "Policy: It is the policy of Eisenhower Medical Center ("EMC") that the confidentiality of Protected Health Information contained in records and collected pursuant to treatment will be protected to the fullest extent possible..."
