Issue:

Based on interview and hospital document review, the hospital failed to prevent the disclosure of Patient Hh's protected health information (PHI) to unauthorized individuals. Additionally, the hospital failed to notify the patient within five business days of their knowledge of the breach.Findings:Review of hospital documentation showed Patient Hh was in the Emergency Department (ED) on 7/30/12. While in the ED Patient Hh's addressograph was accidently used to stamp a Medication Reconciliation form belonging to another patient. The disclosed PHI, on the addressograph, belonging to Patient Hh included hospital name, patient name, date of birth, age, sex, medical record and account numbers, date of admission and the physician's name.On 8/3/12, the Hospital Compliance Officer was made aware of the breach of PHI involving Patient Hh. The hospital notified Patient Hh of the unauthorized disclosure of the PHI on 8/23/12.On 2/7/12 at 1100 hours, during a telephone interview the Hospital Compliance Officer confirmed the breaches of PHI and dates as documented.
