Issue:

Based on interview and hospital document review, the hospital failed to prevent the disclosure of Patient Dd's protected health information (PHI) to unauthorized individuals. Additionally, the hospital failed to notify the patient and the Department within five business days of their knowledge of the breach.Findings:Review of hospital documentation showed on 7/24/12, the Emergency Department (ED) Director was made aware a breach of PHI occurred in the ED on 7/22/12, involving Patient Dd. The Hospital Compliance Officer was made aware of the breach of PHI on 8/23/12.On 7/22/12, Patient Dd's addressograph was used to stamp the After Care Instructions form belonging to another patient in the ED.The PHI belonging to Patient Dd disclosed on the addressograph stamp included the hospital's name, patient name, age, sex, DOB, medical record and account numbers, date of admission and the physician's name.The hospital's ED Director was made aware of the breach of PHI on 7/24/12. Both the Department and Patient Dd were made aware of the breach of PHI on 8/23/12.On 2/7/13 at 1100 hours, during a telephone interview the Hospital Compliance Officer confirmed the breaches of PHI and dates were as documented.
