Issue:

Based on interview and hospital document review, the hospital failed to prevent the disclosure of Patient Ee's protected health information (PHI) to unauthorized individuals. Additionally, the hospital failed to notify the patient within five business days of their knowledge of the breach.Findings:Review of hospital documentation showed on 8/1/12, the Hospital Compliance Officer was made aware a breach of PHI which occurred in the Emergency Department on 7/27/12.Further review showed a prescription written for Patient Ee was given to another patient in error. The prescription had Patient Ee's name on it. However, when the other patient was contacted it was discovered the prescription was not filled and was discarded.The hospital's knowledge of the breach occurred on 8/1/12. Patient Ee was notified of the breach of PHI on 8/27/12. On 2/7/13 at 1100 hours, during a telephone interview the Hospital Compliance Officer confirmed the breach of PHI and date was as documented.
