Issue:

Based on interview and record review, the facility failed to maintain the confidentiality of discharge instructions for Patient A were given to Patient B. This resulted in a breach of private health information (PHI).Findings:On 5/30/12 at 3:00 PM, the privacy officer for the facility was contacted regarding an entity self-report of a possible breach of information for Patient A.During a phone interview with the privacy officer on 5/30/12 at 3:15 PM, he stated,"Patient A [used Patient A's name] was in our observation unit and was being discharged. He received written instructions and went home. [Patient A] realized he had received the wrong information and returned it to the facility and was given his correct discharge instructions".During a review of the data that had been sent in error on 5/31/12 at 2:00 PM, it was noted to include Patient B's name, patient ID number, medical record number, date of birth, physician's name, recommended diet and physical restrictions.During a review of the letter sent to Patient B on 5/25/12, the facility acknowledged that a breach of PHI had occurred.
