Issue:

Based on interview and record review, the facility failed to prevent unauthorized access to to patient's (Patient A's) when an RN sent an e-mail to administrative staff and her union.Findings:On April 5, 2013, a review of a letter written by RN 1 that included Patient A's name, admission date, medical record number, and diagnoses which was e-mailed from home to administrative staff and to the union.On April 5, 2013, an interview was conducted with the CO (Compliance Officer). She stated, "An employee sent an unencrypted e-mail from her home computer with Patient A's PHI. The patient's name, admission date, medical record number, diagnoses, and history. The letter was sent to her union and to human resources over an open system, it went to unintended people."
