Under your proposed tax plan, you have endorsed a number of provisions which would be harmful to family owned businesses, including a large number of our Members. Specifically, we ask that you reconsider the following profound tax increases as these proposed changes would compound the financial and compliance burden on next generation family business owners including many of our Members: Death Tax Plan: Under your proposed tax plan, you have proposed a return to 2009 law for the death tax ($3.5 million exemption and 45% rate vs. $11.7 exemption for individuals/$23.4 million for couples in 2021 and 40% rate). This would more than triple the number of taxpayers currently subject to the death tax including many of our Members. Step up in basis repeal: Stepping up the basis of property protects next generation business owners from the potential of paying double taxes by virtue of a 40% death tax and then another large capital gains tax upon the sale or future passing on of the business. Such an action demands an immense amount of liquidity simply to pay the taxes on a business for which there has been to corresponding influx of cash as there would be in the event of a sale. Capital Gains Due at Death: Death is not a predictable event and when a business owner passes away, inheritors under your plan owe capital gains taxes as if a profitable sale of the family business had occurred. This presumes a high degree of liquidity that the average small business owner does not have and would jeopardize many family businesses. Taxing Capital Gains as Ordinary Income: A part owner of a large family business would potentially have to pay the ordinary income tax rate on a small business they inherited at death versus the capital gains tax rate. Again, this proposed policy presumes liquidity that the average small business owner does not have and would, as a result, jeopardize many family businesses. Repeal of LIFO (Last In/First Out): Any repeal of the Last In/First Out accounting method should not be adopted. There are approximately 10,000 businesses that use the LIFO method based on IRS statistics and most of the businesses that use the LIFO method are small businesses rather than large, publicly traded companies. We oppose HR 4006 and similar pieces of legislation allowing tampering with equipment.

Past Administrations and their respective infrastructure initiatives have focused on urban and suburban infrastructure while failing to address the unique needs of rural communities. We ask that your Administration prioritize rural communities and these unique needs as part of a comprehensive infrastructure renewal effort. American agriculture takes immense pride in feeding the world and our industry creates millions of jobs for U.S. workers. Plainly, our neglected and deteriorating infrastructure threatens our position in the world market. We appreciate that your plan specifically includes roads and bridges, locks and dams, railroads, electrical, water systems and broadband. While you have already ordered review of the Navigable Waters Protection Rule, we encourage you to maintain the rule finalized under the prior Administration. The existing Regulation respects the limited powers that the executive branch has been given. Our Members serve farmers and ranchers across the United States. The current regulation has restored the proper balance between federal and state regulation of our nations waters and protect our rivers, streams and lakes without stifling farming, ranching and the construction of important infrastructure improvements which are necessary to get agricultural products to market.

The Federal Communications Commissions (Commission) recent failure to stay the Ligado Order, and to thereby respect that congressional purpose as articulated in the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (NDAA), is problematic given Congress clear view that the Ligado Order insufficiently and/or erroneously assessed the real-world risks of the harmful interference that would be caused by Ligados proposed terrestrial network. A broad cross-section of commercial and federal users across industries and professions, including farmers and ranchers who rely on satellite services to meet their precision agriculture needs, are fundamental to our economy, national security, and safety. We respectfully urge the Administration to work with your counterparts in the Senate and ensure that that the Commission reverses its decision denying the Petition for Reconsideration and to Stay the Order in favor of an immediate stay and reconsideration of that decision

Congress contemplated that any exemptions to Section 1201(a)(1)(A) would be revisited triennially to determine whether users of certain copyrighted works are, or are likely to be in the succeeding 3-year period, adversely affected by virtue of [the anti-circumvention law] in their ability to make noninfringing uses[.] 17 U.S.C. 1201(a)(1)(B). In so doing, Congress contemplated that any such exemptions would be temporary and closely scrutinized. These exemptions should not be transformed into the equivalent of a permanent statutory exemption by virtue of presumptive, successive renewals. Any proposed expansion of Proposed Class (b)(9), as set forth in Proposed Class 12, requires cautious review and restraint to avoid impairing intellectual property rights. Proposed Class 16 exceeds the permissible scope of an exemption in these proceedings. Section 1201(a)(1)(B) limits the scope of any anti-circumvention exemption to users of a copyrighted work which is in a particular class of works, if such [users] are, or are likely to be in the succeeding 3-year period, adversely affected by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works[.] (Emphasis added.) As the Copyright Office noted, this rulemaking process requires a showing of distinct, verifiable and measurable adverse impacts on noninfringing uses, which cannot be hypothetical, theoretical, or speculative and must be real, tangible, and concrete. Id. (citing Commerce Committee Report at 37; Section 1201 Study at 119-21). For these reasons, broad proposed categories such as fair use works or educational fair use works [are] inappropriate. Id. (citing 2015 Recommendation at 100 (citing 2006 Recommendation at 17-19).

EDA supports efforts to modernize grant funding programs so that federal education dollars are spent on educating the workforce of tomorrow and remediating the United States' existing skills gap. S.839/H.R.3497, The Jumpstart our Businesses by Supporting Students Act JOBS Act), and S.1517/H.R. 2831 the Building U.S. Infrastructure by Leveraging Demands for Skills (BUILD Act) are examples of education funding reform which EDA supports. These pieces of legislation provide a starting point for continued broadening of grant funding for non-conventional students. EDA opposes H.R. 2474/S.1306 the PRO Act. The PRO Act contains provisions that would allow arbitrators with no business experience and no accountability to set contract terms. The bill would also codify into law the controversial Browning-Ferris Industries joint-employer standard, exposing nearly every business relationship to liability for unlawful behavior committed by any entity with which they do business, such as contractors, suppliers, and franchisees. Similarly, the PRO Act would greatly narrow the circumstances under which an individual can work as an independent contractor, thus substantially diminishing opportunities for Americans to find flexible ways to earn money on their schedule or start their own business. The PRO Act also violates employees rights to privacy and association. The bill mandates employers provide the contact information for all employees without prior approval from the employees themselves to union organizers. Finally, employers due process rights are entirely disregarded by the bill. Under the PRO Act employers would not be able to challenge union misconduct during union elections, their right to counsel on complex labor laws would be practically eliminated, and secondary boycotts would be permitted, allowing unions to target neutral third parties and cause them economic injury even if those entities have no underlying labor dispute with the union. The Paycheck Protection Program Flexibility Act of 2020 (the Flexibility Act or H.R. 6886), which EDA supported, was signed by President Trump on June 5, 2020 making significant changes to the Paycheck Protection Program (PPP). These changes will triple the time allotted for equipment dealers and other PPP loan recipients to utilize the funds and still qualify for loan forgiveness through the Small Business Administration (SBA). EDA opposes the COVID-19 Every Worker Protection Act of 2020 (H.R. 6559, included as Division L, Title III in H.R. 6800). EDA opposes the Occupational Safety and Health Administration (OSHA) issuance an Emergency Temporary Standard (ETS) in response to the coronavirus pandemic. EDA supported the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (NDAA or S. 4049),because it addressed the harmful interference that would be caused by the initial Ligado Order.

EDA opposes Title IV of S. 2563 of the Improving Laundering Laws and Increasing Comprehensive Information Tracking of Criminal Activity in Shell Holdings Act (ILLICIT CASH ACT). The reporting requirements in the legislation would not only be duplicative, but they would also be burdensome. Failure to comply with these reporting requirements would be a federal crime with civil penalties of $500 per day and up to $10,000, criminal penalties of up to 4 years in prison, or both. EDA opposes Title LIV of S. 4049, Establishing Beneficial Ownership Information Reporting Requirements. This amendment circumvents the normal legislative process as it has never been considered in committee. This amendment would impose duplicative, burdensome reporting burdens on millions of small businesses in the United States and threatens the privacy of law-abiding, legitimate small business owners.

(United States, Mexico, Canada Agreement). While far from perfect, this Agreement will ensure that our relationship with our North American Trading partners continues and does not deteriorate further. EDA opposes the continued tariffs targeting Canadian and Mexican steel and aluminum. Trade retaliation by Mexico and Canada, because of these tariffs, is estimated to lead to a decline in United States agriculture exports to these trading partners in the range of 1.9 billion dollars. EDA supports common sense reform to the broken and unworkable H-2B program. This program is critical for seasonal staffing in needed to support the health of our customers. We view this as a workforce issue rather than simply an issue of immigration or immigration reform. Specifically, EDA supported the adoption of the Tillis- Harris Amendment and would like to see legislation of this caliber re-introduced this Congress. Pertinent aspects of the Amendment included: A permanent increase in the cap from 66,000 to 132,000 visas. Cap exempt visas, within specified SOC Codes, for workers performing work that directly supports the reconstruction or restoration of physical property and infrastructure or debris clean-up and removal related to natural disasters, in declared disaster states. H-2B employers will be required to participate in the federal E-Verify program for all employees hired no later than 1 year after enactment of legislation AND within 3 years of enactment ALL hires made on or after October 1, 2012. For each worker who fails E-Verify, the employer may replace the worker with a cap exempt H-2B worker for up to three years. The worker would count against the cap after the third year. Increase in the anti-fraud fee from $150 to $350 per petition. Establishment of DOL electronic jobs registry. DOL will collect a fee from H-2B employers to pay for this registry. Definitional changes to the H-2B program allowing employers to utilize the H-2A program for workers in the forestry, horticulture, aquaculture (seafood processing) and equine related services.

FLSA "White Collar" Exemptions, Proposed Rule (RIN 1235-AA20) (84 Fed. Reg. 10900, March 22, 2019) :EDA believes that employees and employers alike are best served with a system that promotes maximum flexibility in structuring employee hours, career advancement opportunities for employees, and clarity for employers when classifying employees. EDA supports common sense reform to the broken and unworkable H-2B program. This program is critical for seasonal staffing in needed to support the health of our customers. We view this as a workforce issue rather than simply an issue of immigration or immigration reform. Specifically, EDA supported the adoption of the Tillis- Harris Amendment and would like to see legislation of this caliber re-introduced this Congress. Pertinent aspects of the Amendment included: A permanent increase in the cap from 66,000 to 132,000 visas. Cap exempt visas, within specified SOC Codes, for workers performing work that directly supports the reconstruction or restoration of physical property and infrastructure or debris clean-up and removal related to natural disasters, in declared disaster states. H-2B employers will be required to participate in the federal E-Verify program for all employees hired no later than 1 year after enactment of legislation AND within 3 years of enactment ALL hires made on or after October 1, 2012. For each worker who fails E-Verify, the employer may replace the worker with a cap exempt H-2B worker for up to three years. The worker would count against the cap after the third year. Increase in the anti-fraud fee from $150 to $350 per petition. Establishment of DOL electronic jobs registry. DOL will collect a fee from H-2B employers to pay for this registry. Definitional changes to the H-2B program allowing employers to utilize the H-2A program for workers in the forestry, horticulture, aquaculture (seafood processing) and equine related services.

We oppose any amendments which would weaken crop insurance programs. Crop insurance is food security insurance, and food security is national security. Crop insurance is critical to the rural economy. Without crop insurance most producers simply cannot qualify for the operating loans needed to put a crop in the ground. We urge Conference Members to oppose amendment that would: oIncrease the cost of crop insurance to farmers. oReduce the number of farmers eligible for crop insurance and thereby reduce the risk pool. oCut the efficient and effective private sector delivery of crop insurance. We applaud the inclusion of the Precision Agriculture Connectivity Act in the 2018 Farm Bill. This legislation will ensure that the federal government evolves along with the technology that has revolutionized modern agriculture. Broadband deployment in unserved and underserved croplands and ranchlands is essential to farmers and ranchers who produce the food, fuel and fiber across the United States and around the world. Without rural broadband modern equipment is underutilized and crops are not being planted or harvested to the full extent possible. Equipment maintenance and repairs can be performed using remote technology but that technology requires internet connectivity. Agricultural Equipment Dealers and Manufacturers have made a commitment to end users to provide a host of diagnostic and repair information by 2021. In order to utilize this information, end users will need access to the internet in the field. The combination of our industry commitment and advances in rural broadband will lead to less downtime for farmers and optimum efficiency in the field at vital times.

EDA supports tax reform efforts. Our general policy positions are outlined as follows: DEPRECIATION: a.Change the farm and ranch equipment assigned class life to five years for depreciation purposes. This will match the same assigned class life of construction equipment. b.Modify the current depreciation schedules for equipment dealer buildings and their contents to accurately reflect actual lifetime usage rates and specialty uses to match the industrys needs. LIKE KIND EXCHANGES: a.IRC Section 1031 like-kind exchanges have existed since 1921. The rationale for allowing property owners to defer taxes on asset transfers when they continue their investment in like-kind assets is as valid today as it was in 1921. EDA supports allowing taxpayers to defer taxes when exchanging farm property for farm property (Section 1031 like-kind exchanges). EDA also supports increasing the time allowed to identify exchange property from 45 days to six months and the time allowed to close and receive property from six months to one year. TECHNICIAN TOOL DEDUCTIONS: a.The large majority of Americas over 4 million technicians/mechanics must buy their own tools as a condition of employment. Best business practices support this requirement because the user of the tool has the best knowledge of what is needed for the job, and is the best person to maintain and secure the tool. If the employer buys tools, they would be depreciated or expensed on the employers tax return. But, when the employee buys tools as an agent of the employer, the employer typically increases the employees compensation to account for his investment on behalf of the employer. Past infrastructure initiatives often focused on urban and suburban areas while not adequately addressing the unique needs of rural communities. LIFO: a.Do NOT repeal Last-In, First-Out (LIFO) accounting. We oppose any repeal of Last-In, First-Out (LIFO) accounting. LIFO is an accepted accounting method that has been used by our equipment dealers to determine both book income and tax liability. It has been an accepted and established accounting method in the United States for 70 years and any repeal of this tax provision will have significant negative impacts on our dealers currently utilizing LIFO. LIFO also is not a tax expenditure, and repeal would be an unprecedented retroactive tax increase. The LIFO method of inventory best measures income and maximizes cash flow for businesses with inventory costs that are subject to inflation. LIFO and FIFO achieve the same purpose - most closely matching cost of goods sold with the cost of replacement inventory to ensure sufficient after-tax cash flow to ensure business viability. Forcing LIFO users to move to FIFO would create unfair competitive advantages for some companies and industries over others. According to the SBA Office of Advocacy, LIFO repeal would put a significant number of small businesses out of business. According to a 2016 Tax Foundation study, prospective LIFO repeal would lower GDP, cost jobs, and reduce revenue (by as much as $500 billion) annually; retroactive repeal could have an immediate, short-term negative impact on economic output and employment. DEATH TAX: a.Repeal the Death Tax. We support H.R. 631, the Death Tax Repeal Act of 2017 which was introduced by Congresswoman Kristi Noem. BUSINESS EXPENDITURES: a.Delete IRC Section 263A of the IRS Code method that requires businesses to capitalize certain costs, such as labor, handling, purchasing and storage of inventory products, if the business has more than $10 million in annual sales. PASS THROUGH TAXATION: a.Ensure tax reform has a balanced approach to taxation through fair and reasonable personal and corporate rates, and doesnt penalize pass-through entities with double taxation.

H.R. 5, introduced by Congressman Bob Goodlatte, is a bill we supported and would like to see passed in the Senate. It is currently being considered by the Senate Committee on Homeland Security and Governmental Affairs. H.R. 5 includes vital reform mechanisms including: 1.Requiring agencies to use less costly regulations, rather than more costly regulations, to achieve a given objective. 2.Enabling the judiciary to end judicial deference to bureaucrats statutory and regulatory interpretations. 3.Requiring agencies to explain how their actions affect small business owners, employees, and customers. 4.Preventing new rules with billion-dollar annual costs from taking effect until litigation against them has been resolved. It would not affect current regulations. 5.Requiring agencies to publish already-mandatory transparency reports that they regularly dodge. 6.Requiring agencies to publish summaries of their new rules in the English language, more or less.

Right to Repair legislation is a trend that EDA has been tracking at the state and federal level. We oppose H.R. 862, known as the You Own Devices Act, introduced by Congressman Blake Farentold. We are concerned that this type of legislation has serious safety and liability concerns. There is currently a great deal of service and repair information which is made available to owners and independent service providers who want to service equipment. As such, the idea that equipment owners cannot service their own equipment is false. In fact, authorized dealers and original equipment manufacturers (OEMs) are partners with their customers offering a wide range of training and educational opportunities to allow customers to perform maintenance and to maximize the productivity of their equipment! That said, repairing highly specialized equipment is an ongoing effort that requires both skill and continued education on the part of OEMs and authorized dealers. The service, diagnostic and repair information that is, in fact, restricted by OEMs to authorized dealers is restricted because this information requires a high degree of skill to interpret the data and perform repairs safely.

We have also asked our members to write letters supporting Like-Kind-Exchanges in the tax code. We also belong to an industry coalition that opposes changes in the LIFO method of inventory accounting for tax purposes. We are seeking to the extension of bonus depreciation and Section 179 provisions beyond 2013. Monitoring the progress of the Marketplace Fairness Act (S. 336 and H.R. 684) that streamlines the collection of state's sales taxes and collections. We have also asked our members to write letters supporting Like-Kind-Exchanges in the tax code. The belief is that the farm bill is constructed with considerable care and deliberation to serve as the overarching farm safety net policy for five years. Allowing the current farm bill to be decided during hasty yearly appropriations bills strips authority from the Agriculture Committees and moves the legislative process further from the thoughtful debate that crafts better policy. During consideration of H.R. 2112, the House Appropriations Committee adopted amendments that would effectively amend the 2008 farm bill with detrimental results for farm safety net programs. H.R. 2112 also contains large reductions in many of the programs authorized and funded through the 2008 farm bill. Decisions on how much mandatory spending should be allocated to programs that benefit farmers, rural communities, researchers and others should be made by the authorizing committee, such as the Agriculture Committees on both the House and Senate.
