Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of an order for a magnetic resonance imaging (MRI) x-ray study meant for Patient A, to be given to Patient B.Findings:An interview was conducted with the facility's Compliance Specialist (CS) on October 16, 2012, at 10:15 a.m. The CS stated a Physician Assistant incorrectly printed out Patient A's order for a MRI and gave it to Patient B.The CS further stated the MRI order reflected Patient A's name, date of birth, address, telephone number account number and insurance information.A review of the facility policy, "HIPPA (health information privacy and portability act (last reviewed 11/18/2011)," was conducted. The policy indicated, "To protect the patient's right to privacy and confidentiality, at no time will names or information be shared with any person who does not have a need to know in order to provide patient care."
