Issue:
Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's discharge information to Patient B.Findings:An interview was conducted with the facility's Compliance Specialist (CS) on October 16, 2012, at 11 a.m. The CS stated a discharge planning coordinator gave Patient A's discharge information to Patient B.The CS further stated Patient A's PHI given to Patient B reflected the Patient A's name, date of birth, telephone number, address, social security number, account number, medical record number and insurance information. Also included in the PHI were discharge instructions, including follow up medical care and instructions related to Patient A's discharge diagnosis.A review of the facility policy, "HIPPA (health information privacy and portability act (last reviewed 11/18/2011)," was conducted. The policy indicated, "To protect the patient's right to privacy and confidentiality, at no time will names or information be shared with any person who does not have a need to know in order to provide patient care."
