18 U.S.C. 2381 reads: "Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death [.]"

The Supreme Court had occasion to interpret this law when Thomas Jefferson ordered the arrest of Aaron Burr on charges of treason...simply because Burr was doing some "weird shit" out west with a militia.

The Supreme Court acquitted on the grounds that no violent act had occurred, but not before warning future generations that if a violent act had been done, no matter how small, then not only Burr, but anyone remotely associated with Burr was a traitor and would suffer death

This was a generation who knew how to prosecute a successful rebellion. And they knew that once that first hand is raised against the sovereign, unless someone chops it off right then and there, the rebellion is largely won before it even really began.
