Issue:

Based on staff interviews and review of facility documents the facility failed to prevent the disclosure of patient A's health information (PHI) while in the emergency department (ED) when another ED patient received Patient A's discharge instructions.Findings:On 2/10/12 at 12:30 p.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the facility investigation report showed that on 5/13/09 an ED registered nurse (RN) discharged a patient with that patient's paperwork and Patient A's discharge instructions. A pharmacist at a local pharmacy notified the facility of the error and destroyed patient A's discharge instructions. A review of the instructions showed that Patient A received after care instructions for a hand injury and received two prescriptions.The CO was interviewed on 2/10/12 at 1:05 p.m. and stated that the RN that was involved had been given a disciplinary document which indicated that all patient information should be reviewed to ensure that all patients receive the correct information.
