Issue:
Based on staff interview and review of the facility documents, the facility failed to report an incident of unauthorized disclosure of a patient's medical information to the Department within 5 calendar days.Findings:On 2/10/12 at 12:30 p.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the facility investigation report showed that on 5/13/09 an ED registered nurse (RN) discharged a patient with that patient's paperwork and Patient A's discharge instructions. A pharmacist at a local pharmacy notified the facility of the error and destroyed patient a's discharge instructions. A review of the instructions showed that Patient A received after care instructions for a hand injury and received two prescriptions.The facility detected the incident on 5/13/09 and the Department received a notification by mail on 5/20/09 (2 days after the incident should have been reported.On 2/10/12 at 1:45 p.m. the facility's Compliance Officer (CO) was asked if they were aware of the 5-day reporting component and she stated, "Yes, but during that time all the incidents were sent to their corporate headquarters for review prior to reporting." The CO sated that they no longer do this.
