Issue:

Based on staff interview and review of facility documents, the facility failed to prevent the unauthorized disclosure of Patient A's health information (PHI) when a facility employee incorrectly faxed Patient A's discharge summary to an out of state business. Findings:On 2/10/12 at 2:30 p.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the investigation showed that on 1/15/09, the facility's case manager (CM) had faxed a copy of an infant's discharge summary to an out of state business. The recipient of the fax called the facility's medical records department and left a message about receiving the fax in error. The CO was notified and spoke with the recipient who stated that the information "Had not been read" and she would delete it from her files. On 2/10/12 at 2:30 p.m., on interview, the CO stated that after her investigation it was determined that the CM had incorrectly entered the intended fax number. The CO stated that the CM received a disciplinary action that reiterated the seriousness of confirming the correct number before any patient information is faxed.
