Issue:

Based on staff interview and review of facility documents, the facility failed to prevent the unauthorized disclosure of Patient A's health information (PHI) when lab tests intended for Patient A's orthopedist was faxed to a local business instead of Patient A's doctor. Findings:On 2/10/12 at 11:25 a.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the investigation showed that on 2/1/10, a facility employee faxed Patient A's lab results to a pre-programmed fax phone number of the orthopedic office. Later the employee received a call from a local business that stated that they had received the fax. The employee refaxed the tests by hand dialing the number. The employee called verified that it was received by the orthopedic office.On 2/10/12 at 11:30 a.m., the CO stated that the local business had not been pre-programmed into the fax and that the employee had used the pre-programmed number for that office. The CO stated that they were unable to discover how the incident occurred. The CO stated that the facility's telecommunications department blocked the local business from accessing the facility's phone system.
