Issue:

Based on staff interviews and review of facility documents, the facility failed to prevent unlawful or unauthorized access to, and use or disclosure of, Patient A's medical information when a facility employee mailed the results of a screening exam and other personal information to another patient. Findings:On 2/10/12 at 11:05 a.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the investigation showed that on 6/9/09, a patient had called the facility and stated that he had received another patients' (Patient A) screening and personal information. The information was mailed back to the facility by the patient who received the wrong medical information. On 2/10/12 at 11:10 a.m., the employee that had mailed the information in error was interviewed via telephone with the CO. The employee stated that she had, "Made a mistake and wasn't exactly sure how she did it." The employee stated that she had received a disciplinary write-up regarding the importance of ensuring patient confidentiality. The employee stated that she tries to be more accurate when she mails any patient information out. The CO stated that to her knowledge, there were no other errors related to these mailings.
